Let's be clear; I am in no way making a statement on whether or not you should or should not get vaccinated. I believe that vaccination is a personal decision that you should take the time to research and understand yourself before undertaking or ignoring. This sentiment, on the other hand, is what I seek to address.
For the last nine months, the media, government and every other major entity have told the American public to get vaccinated. As time has gone on, this fervor has increased in severity, with many organizations and individuals outright demanding the government, either on a local, state or federal level, invoke a mandate for the Covid-19 vaccine.
The truth is, according to Congress.gov, all three branches of government in the United States do have the capability and power to conduct this mandate. This power comes from the 1905 Supreme Court case, Jacobson v Massachusetts, which granted the government the ability to administer a vaccine mandate in response to the smallpox epidemic. There is, however, one highly notable point within the Court's decision.
"The police power of a State, whether exercised by the legislature, or by a local body acting under its authority, may be exerted in such circumstances or by regulations so arbitrary and oppressive in particular cases as to justify the interference of the courts to prevent wrong and oppression." (ncbi.nlm.nih.gov)
The Court noted that anyone who could potentially suffer health complications, up to and including death, should not have the law used against them in any way.
This idea is the heart of my issue. Contrary to the majority of opinions that I have read, including that of the FDA, since the approval of the Covid-19 vaccine, I do not believe there is sufficient evidence to market this vaccine as one-hundred percent safe and viable. As stated by Dr. Lee Merritt's quote, there has never been a successful animal-based trial regarding a virus of the likeness of Covid-19, nor a successful human trial. In the decade of research into mRNA vaccines, the farthest scientists got in their examinations is using mRNA vaccines on cats and ferrets. Furthermore, Moderna and Pfizer are currently the first mRNA-based vaccines to be approved.
As Dr. Thomas Siler writes, "Operation Warp Speed was remarkable, but it leaves an uncomfortable question: Is it a good thing to rush a vaccine (or medicine) to the public without the usual safeguards? Operation Warp Speed might be a great business objective or military goal, but is it great for a medical treatment?"
The truth is, mRNA vaccines have a great deal of potential in fighting various viruses, especially those that express a high mutation rate; however, it is irresponsible and dangerous to cut corners in anything of this nature. It is well documented at this point that Operation Warp Speed, under the leadership of President Donald Trump, did, in fact, cut corners and jumped to distribution at an unheard-of pace. The FDA assures the public that they are closely monitoring for potential safety hazards; however, at this point, the cat is already out of the bag.
Lastly, we have the Nuremberg Code, a doctrine currently being used by anti-Covid-vax representatives to protest mandated vaccinations. Created in the aftermath of Nazi experiments in World War II, the Nuremberg Code essentially states that no person should face subjugation to any form of experimentation. The Code even directly states, "The voluntary consent of the human subject is absolutely essential." The existence of this document does not rule out the possibility of a vaccine mandate as it was only adopted by the United States, and the government could simply choose to ignore it. It is, however, crucial to note that there is no legal documentation regarding the terminology of the Covid-19 vaccine being experimental; thus, any argument for either side is still disputable in the eyes of the law-making any and all information relevant for consideration.
Once again, I am not arguing that people should not get the vaccine, in fact, there are many circumstances where I am an avid supporter of getting the shot. I do, however, believe in and understand the caution people have, and, unlike many journalists, I do not believe simply slapping a label on something makes it so. There are a serious number of questions that have yet to be answered by the scientific community in regards to the safety of the Covid-19 vaccine, and running around trying to silence people with these concerns is not helping anything; rather, with many people, doing so only seals these hostile notions.
